The insurer for the late Mr Kerk will not only have to pay for the total loss of the car, but also compensate the late Mr Ng's dependants for the loss of his income, and his pain and suffering during the 1.5 hours from the time of accident till he finally succumbed to his multiple injuries.
There will also be legal fees for the insurer as well as the estate of the late Mr Ng.
All these will pend the results of investigation by the Traffic Police and the verdict by the State Coroner in due course. A post-mortem toxicological test would undoubtedly have been done to establish whether the late Mr Kerk was under the influence of any intoxicating drugs or alcohol.

It could have been worse.What if the car had crashed into some pedestrains,instead of a tree.
While we await the out come of the investigation;the pointlessness of this tragedy does strike you acutely.Could it have been avoided with a little more care and restraint?Perhaps,yes.
That the car broke into 2 pieces gave an indication of how great the impact was (meaning the car might have been speeding), and/or the design inadequacy of the safety features.
Could the presence of side impact steel bars have prevented the loss of lives? In the strive for fuel economy, Japanese car manufacturers may have traded off safety for light-weightedness.

In the battle of metal vs skin and bones, well,.. yes, better the tree than some innocent pedestrians.
It is a deadly combination - certain young male drivers with their fast cars. The prohibitively high insurance premiums for young men and their high-performance cars obviously do not diminish their need for speed in any way.
